These Terms of Service ("Terms") govern your access to and use of getmailperch.com and the MailPerch platform (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
MailPerch provides email list cleaning, permission-based campaign sending, landing-page and funnel building, an email designer, segmentation, analytics, and automation tools. Features and limits vary by plan and may change as the Service evolves.
You must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account. You must be at least 16 years old (or the age of majority in your jurisdiction) to use the Service.
You agree to use MailPerch lawfully and responsibly. In particular, you agree that you will:
To protect deliverability for all users, we monitor bounce and complaint rates and may pause sending, suspend, or terminate accounts that violate these rules or threaten platform reputation.
You retain ownership of the contact lists and content you bring to MailPerch. You are responsible for having a lawful basis to process that data and for the content of the messages you send. Our handling of personal data is described in our Privacy Policy.
MailPerch offers a free plan and paid plans (Starter, Growth, Scale, and custom Team plans). Paid features and usage limits apply per plan. Where paid billing is enabled, fees are charged in advance and are non-refundable except where required by law. We may change pricing with reasonable notice; changes do not affect the current paid period.
The Service, including its software, design, and content we create, is owned by MailPerch and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms. You may not copy, resell, or create derivative works of the Service without permission.
The Service is provided "as is" and "as available." Email deliverability depends on many factors outside our control, including recipient mail servers and your own sending practices and list quality. We do not guarantee that any email will be delivered, opened, or that verification or lead data will be perfectly accurate.
To the maximum extent permitted by law, MailPerch will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the three months before the claim.
You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service and its users. On termination, your right to use the Service ends and we may delete your data subject to our retention practices.
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-laws principles, unless a mandatory local law applies to you.
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, by notifying you. Continued use after changes means you accept them.
